{"id":1708,"date":"2025-05-07T12:35:08","date_gmt":"2025-05-07T12:35:08","guid":{"rendered":"https:\/\/redaksitimor.com\/?p=1708"},"modified":"2025-05-07T12:35:08","modified_gmt":"2025-05-07T12:35:08","slug":"kejati-maluku-dan-kejari-ambon-berhasil-merehabilitasikan-pengguna-narkoba-melalui-keadilan-restoratif","status":"publish","type":"post","link":"https:\/\/redaksitimor.com\/?p=1708","title":{"rendered":"KEJATI MALUKU DAN KEJARI AMBON BERHASIL MEREHABILITASIKAN PENGGUNA NARKOBA MELALUI KEADILAN RESTORATIF"},"content":{"rendered":"<p><strong>REDAKSITIMOR.COM, Ambon,<\/strong> Kejaksaan Tinggi Maluku bersama jajarannya pada Kejaksaan Negeri Ambon, berhasil menghentikan penuntutan Perkara Narkotika berdasarkan Keadilan Restoratif yang diajukan ke Direktur B pada Jaksa Agung Muda Tindak Pidana Umum Kejaksaan Agung Republik Indonesia Wahyudi, S.H.,M.H beserta Tim, melalui Video Conference diruang Vicon Pidum Kejaksaan Tinggi Maluku, pada hari ini Rabu (07\/05\/2025)<\/p>\n<p>Mewakili Kepala Kejaksaan Tinggi Maluku, hadir dalam pelaksanaan Restoratif Justice tersebut yakni Wakil Kepala Kejaksaan Tinggi Maluku Jefferdian, Asisten Tindak Pidana Umum Yunardi, S.H.,M.H, Kasi A Hadjat, S.H, Kasi B Junetha Pattiasina, S.H.,M.H dan Kasi C Ahmad Latupono, S.H.,M.H. Sedangkan Kepala Kejaksaan Negeri Ambon Dr. Adhryansah, S.H.,M.H beserta jajaran pada Bidang Pidum, hadir melalui sarana Video Conference diruang Vicon Kejaksaan Negeri Ambon.<\/p>\n<p>Tersangka \u201cARM\u201d alias Cide diketahui melanggar kesatu Pasal 114 Ayat (1) Undang-Undang R.I. Nomor 35 Tahun 2009 tentang Narkotika atau kedua Pasal 112 Ayat (1) Undang-Undang R.I. Nomor 35 Tahun 2009 tentang Narkotika ATAU KETIGA Pasal 127 Ayat (1) huruf a Undang-Undang R.I. Nomor 35 Tahun 2009 tentang Narkotika.<\/p>\n<p>Namun berdasarkan pertimbangan Tim Restorative Justice Kejaksaan Negeri Ambon, tersangka dinyatakan sebagai korban penyalahgunaan Narkotika yang didasari dengan hasil pengujian laboratorium projusiticia Nomor : 449\/0001\/Labkes\/I\/2025 tanggal 06 Januari 2025, pada urine tersangka dengan hasil Positif Methampetamine, sehingga perlu dilakukan rehabilitasi terhadap tersangka.<\/p>\n<p>Selain itu, di Rumah RJ Kejaksaan Negeri Ambon, yang dihadiri oleh Jaksa Fasilitator, Tersangka, Istri Tersangka, dan Tokoh Masyarakat serta Kepala Kejaksaan Negeri Ambon, juga telah dilakukan penandatanganan Pakta Integritas dan Surat Jaminan dari Istri Tersangka serta Surat Pernyataan dari Tersangka yang menyatakan bersedia menjalani rehabilitasi melalui proses hukum.<\/p>\n<p>Atas dasar berbagai pertimbangan tersebut yang disertai dengan Pedoman Jaksa Agung Nomor 18 Tahun 2021 tentang Penyelesaian Penanganan Perkara Tindak Pidana Penyalahgunaan Narkotika Melalui Rehabilitasi dengan Pendekatan Keadilan Restorative Sebagai Pelaksanaan Asas Dominus Litis Jaksa dan Surat Edaran Nomor 1 Tahun 2025 tentang Optimalisasi Penanganan Perkara Tindak Pidana Penyalahgunaan Narkotika Berdasarkan Pendekatan Keadilan Restoratif.<\/p>\n<p>Maka perkara yang diajukan untuk dilakukannya Penghentian Penuntutan, telah disetujui oleh Tim Restoratif Justice pada Jaksa Agung Muda Tindak Pidana Umum Kejaksaan Agung Republik Indonesia untuk dilakukan Penghentian Penuntutannya berdasarkan Keadilan Restoratif, dengan pertimbangan sebagai berikut :<br \/>\n&#8211; Berdasarkan hasil pemeriksaan laboratorium forensik, Tersangka positif menggunakan narkotika;<br \/>\n&#8211; Berdasarkan hasil penyidikan dengan menggunakan metode know your suspect, Tersangka tidak terlibat jaringan peredaran gelap narkotika dan merupakan pengguna terakhir (end user);<br \/>\n&#8211; Tersangka tidak pernah dimasukkan dalam Daftar Pencarian Orang (DPO);<br \/>\n&#8211; Berdasarkan hasil asesmen terpadu, Tersangka dikualifikasikan sebagai pecandu narkotika, korban penyalahgunaan narkotika, atau penyalah guna narkotika;<br \/>\n&#8211; Tersangka belum pernah menjalani rehabilitasi atau telah menjalani rehabilitasi tidak lebih dari dua kali, yang didukung dengan surat keterangan yang dikeluarkan oleh pejabat atau lembaga yang berwenang;<br \/>\n&#8211; Tersangka tidak berperan sebagai produsen, bandar, pengedar, dan kurir terkait jaringan narkotika. **(NN)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>REDAKSITIMOR.COM, Ambon, Kejaksaan Tinggi Maluku bersama jajarannya pada Kejaksaan Negeri Ambon, berhasil menghentikan penuntutan Perkara&nbsp;[&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":1709,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2,26],"tags":[],"newstopic":[37],"class_list":["post-1708","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-berita","category-nasional","newstopic-kejati-maluku"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.5 -
