{"id":1414,"date":"2025-03-20T22:57:29","date_gmt":"2025-03-20T22:57:29","guid":{"rendered":"https:\/\/redaksitimor.com\/?p=1414"},"modified":"2025-03-21T22:57:47","modified_gmt":"2025-03-21T22:57:47","slug":"kejaksaan-tinggi-maluku-bersama-kejari-mbd-berhasil-tuntaskan-kasus-351-lewat-jalur-keadilan-restoratif","status":"publish","type":"post","link":"https:\/\/redaksitimor.com\/?p=1414","title":{"rendered":"KEJAKSAAN TINGGI MALUKU BERSAMA KEJARI MBD BERHASIL TUNTASKAN KASUS 351 LEWAT JALUR KEADILAN RESTORATIF"},"content":{"rendered":"<p><strong>REDAKSITIMOR.COM<\/strong>, Wakil Kepala Kejaksaan Tinggi Maluku Dr. Jefferdian didampingi Asisten Tindak Pidana Umum Yunardi, S.H.,M.H beserta jajarannya secara virtual diruang Vicon Pidum, menerima usulan penghentian penuntutan berdasarkan Keadilan Restoratif dalam perkara 351 dari Kejaksaan Negeri Maluku Barat Daya, pada hari ini Kamis (20\/03\/2025).<\/p>\n<p>Kepala Kejaksaan Negeri Maluku Barat Daya Hery Somantri, S.H.,M.H didampingi Kasi Pidum Reinaldo Sampe, S.H.,M.H beserta Staf, mengajukan permohonan tersebut bersama \u2013 sama dengan Kejaksaan Tinggi Maluku untuk mendapatkan persetujuan dari Jaksa Agung Muda Tindak Pidana Umum Kejaksaan Agung Republik Indonesia terkait penghentian penuntutan dalam Perkara 351 atas nama Tersangka \u201cRT\u201d alias IWAN, yang terjadi di Desa Wakarleli &#8211; MOA Kabupaten Maluku Barat Daya.<\/p>\n<p>Adapun kasus posisi yang menjadi perhatian Tim Restorative Justice Kejaksaan Negeri Maluku Barat Daya untuk dilakukan penghentian penuntutan yakni tersangka \u201cRT\u201d alias IWAN melakukan pemukulan kepada Korban \u201cPAKT\u201d alias PATRA dikarenakan tersangka mengira bahwa korban yang telah melakukan pemukulan terhadap adiknya, namun setelah diselidiki ternyata tersangka salah orang dan akhirnya merasa menyesal dan meminta maaf karena telah melakukan penganiayaan terhadap korban yang masih berstatus anak dibawah umur.<\/p>\n<p>Dalam perkara ini, Tersangka \u201cRT\u201d alias IWAN disangka melakukan tindak pidana sebagaimana diatur dan diancam pidana dalam Pasal 80 Ayat (1) Jo Pasal 76C Undang-Undang Nomor 35 Tahun 2014 tentang perubahan atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak atau Pasal 351 Ayat (1) Kitab Undang-Undang Hukum Pidana yang mengakibatkan anak korban merasakan nyeri, bengkak berwarna kemerahan di punggung dan dan luka lecet di kedua siku akibat kekerasan benda tumpul. Sehingga anak korban sulit beraktifitas seperti biasanya untuk sementara waktu. Atas perbuatan tersebut, kepada tersangka diancam dengan pidana penjara paling lama 3 (tiga) tahun dan 6 (enam) bulan.<\/p>\n<p>Namun, berdasarkan upaya perdamaian dalam bentuk Mediasi yang dilakukan Tim RJ Kejari Maluku Barat Daya pada tanggal 11 Maret 2025, di Desa Wakarleli &#8211; MOA Kabupaten Maluku Barat Daya, dengan melibatkan pihak \u2013 pihak terkait dan berhasil memperoleh kesepakatan yakni yakni pihak anak korban \u201cPAKT\u201d alias PATRA telah memaafkan perbuatan tersangka \u201cRT\u201d alias IWAN dan kedua belah pihak telah sepakat untuk menyelesaikan perkara tersebut secara kekeluargaan tanpa ada persyaratan.<\/p>\n<p>Lebih lanjut dalam pengajuannya, Tim RJ memastikan persyaratan perdamaian dan penerapan Pasal 5 ayat (1) yang tertuang didalamnya telah memenuhi persayaratan yakni tersangka baru pertama kali melakukan tindak pidana dan ancaman pidana penjara dibawah 5 tahun serta nilai kerugian tidak lebih dari Rp 2.500.000,-.<\/p>\n<p>Berdasarkan persyaratan yang diajukan Kejari MBD, maka Tim Restoratif Justice pada Jaksa Agung Muda Tindak Pidana Umum Kejaksaan Agung Republik Indonesia telah bersepakat menyetujui untuk dilakukan Penghentian Penuntutan dalam perkara tersebut berdasarkan Keadilan Restoratif.**(NN)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>REDAKSITIMOR.COM, Wakil Kepala Kejaksaan Tinggi Maluku Dr. Jefferdian didampingi Asisten Tindak Pidana Umum Yunardi, S.H.,M.H&nbsp;[&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":1415,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2],"tags":[],"newstopic":[194],"class_list":["post-1414","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-berita","newstopic-kejaksaan-tinggi-maluku"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.5 -
